The legal status of hemp and hemp-derived products, including those containing CBD, THCa, Delta 9, Delta 8, THCp, and many other compounds may vary from state-to-state.  However, the 2018 Farm Bill legalized hemp and removed it from the federal Controlled Substance Act, as well as hemp extracts and cannabinoids with the stipulation that they must not contain more that 0.3% THC.

This move by the federal government made it possible to develop and create the products that GumGum Tree™ sells, provided they adhere to proper testing with USDA or DEA certified labs. 

 

What type of THC does GumGum Tree™ use?

We have different categories of products that we currently sell on GumGum Tree™

CBD Gummies – our CBD gummies are formulated using full spectrum CBD that is free from any THC or synthetic version of THC.  These products are tested by USDA or DEA labs before they are packaged for sale on our website.  These COA’s (certificates of analysis) can be found attached to every product at the point of purchase.  This allows you to safely purchase the product will full disclosure of what compounds and cannabinoids are present in the product.

THC Gummies – our THC gummies use hemp-derived compounds such as: Delta-8 THC, Delta-9 THC, Live Rosin, or THCp.  All are psychoactive compounds, but they differ in their molecular structures, resulting in caried effects and potencies.  These cannabinoids are found in marijuana and hemp.

Combination Gummies – some of our gummies contain a ratio of both THC and CBD for specific use gummies.  These gummies can have any formula of compounds that we use for both CBD and THC gummies.

 

How do federal and state laws differ?

It is very important to remember that even though hemp-derived products are federally legal, state-by-state laws vary.  Some states have more permissive regulations, while others may impose additional restrictions or outright bans on certain cannabis-derived products.  If you are concerned about your local state rules, we strongly advise you to check with your local governing authorities around Farm Bill compliant products.

 

Can you travel with cannabis products in the US?

The legality of traveling with cannabis products depends on stat-by-state regulations.  We recommend you research and understand the specific laws of your destination and any states through which you may be traveling before packing your favorite products.

Traveling with cannabis products covered under the Farm Bill with 0.3% Delta-9 THC dry weight or less is usually allowed if they comply with both federal and state laws.

Traveling with any cannabis product containing THC that exceeds 0.3% Delta-9 is illegal federally, regardless of state legalization.  Medicinal cannabis with legal documentation in complying states might be a very rare exception but be sure to do your homework before taking any risks.
